Judge Overrules President in Sonar Testing Issue

More good news for the whales. After President Bush attempted to allow the U.S. Navy to test underwater sonar off the coast of San Diego — despite a lawsuit filed by environmental groups and the California Coastal Commission — a federal judge in Los Angeles has ruled that the Navy is not “exempted from compliance with the National Environmental Policy Act” and must follow laws that place strict limits on such testing.

The result is that the Navy must adhere to a 12 nautical mile no-sonar zone off the coast.

White House spokesman Tony Fratto disagreed with the judge’s decision, saying “We believe the (exemption) orders are legal and appropriate.” An attorney for the National Resources Defense Council, had a different opinion, saying “it reinstates the proper balance between national security and environmental protection.”

A spokeswoman for the Navy said the military was examining the decision.
